AI HARDWARE GUIDE
What GDPR and Child-Privacy Requirements Should AI Toy Buyers Verify?
Buyers should verify the full data flow, controller and processor roles, DPA and subprocessors, hosting and transfers, retention and deletion, parental controls, content safety and incident response—not rely on a GDPR-ready label.
THE SHORT ANSWER
Buyers should verify the full data flow, controller and processor roles, DPA and subprocessors, hosting and transfers, retention and deletion, parental controls, content safety and incident response—not rely on a GDPR-ready label.
Map the data flow before claiming GDPR readiness
An AI toy may process voice audio, transcripts, conversation history or summaries, long-term memory, account and parent data, device identifiers, IP addresses, diagnostics and enabled sensor or location data. Buyers should map every step across the toy, app, SDK, speech service, agent, model, storage, logs, analytics, export and deletion.
“No voice storage” does not mean no personal data is retained. Raw audio may be transient while transcripts, summaries, memory, logs or backups remain, so each data category must be checked separately.
Contract and pre-launch verification checklist
Compliance conclusions must be based on the exact production services, regions, settings and contracts—not a demo environment or generic white paper.
- Define whether the brand, platform and cloud providers are controllers, processors or subprocessors, and execute a DPA where required.
- Obtain a current subprocessor list and verify hosting, transfers, encryption, access controls and incident response.
- Confirm the purpose, retention and deletion of audio, transcripts, summaries, memory, logs and backups.
- Provide parental consent, review, export, deletion, account unbinding and safety controls.
- Complete a DPIA, content-safety testing, vulnerability and update planning, and incident and recall contacts.
Child-directed products require model-service eligibility checks
Model providers, APIs, service tiers and regions have different restrictions on minor use. Buyers must verify the public terms and commercial contract for the exact production setup rather than launching merely because a model can be integrated technically.
